BAGUETTE ACADEMY (hereinafter referred to as ” BAGUETTE ACADEMY “) is the operator of the www.baguetteacademy.com website, which offers its users, whether professionals or not, (hereinafter referred to individually as the “ User “) acceso a servicios de formación y perfeccionamiento, digitales o presenciales, en técnicas de panadería francesa y cualquier tema relacionado con la panadería. www.baguetteacademy.com website,) and its content, including training modules, forums, mobile services and all other content, functionalities or applications offered by BAGUETTE ACADEMY and relating to BAGUETTE ACADEMY’s business (hereinafter referred to as the ” Services “). The Services are hosted in France by the company O2SWITCH. These general terms and conditions of sale and use (hereinafter referred to as the “Terms of Use”) constitute mandatory contractual provisions and define the terms and conditions under which BAGUETTE ACADEMY allows its Users to access and use its Services. Any use or viewing of the Services on www.baguetteacademy.com implies that the User becomes a Member and accordingly agrees to comply with the Terms of Use, under the access and registration conditions defined herein.
Every User is deemed to have acknowledged the Terms of Use and to have kept a copy. Acceptance of the Terms of Use is complete and covers all the Terms of Use, which form an indivisible whole. Users cannot choose to apply only part of the General Conditions or make reservations. Therefore, BAGUETTE ACADEMY recommends that the User carefully read the Terms of Use, print a copy, and keep it. Any User who does not accept the terms of the Terms of Use must immediately cease browsing on www.baguetteacademy.com and refrain from using all Services.
The User who wishes to become a member (hereinafter referred to as the “Member(s)“) must comply with the registration procedure provided for on www.baguetteacademy.com and, in particular, expressly approve the Terms of Use at the time of registration.
Membership status allows access, for a fee, to the Services under the conditions defined herein. It is specified that, within the framework of the Terms of Use, the term “User” refers to both Members and simple visitors.
- These Terms of Use are written in French. BAGUETTE ACADEMY provides non-French-speaking Users with translations of these Terms of Use. However, these translations are provided for informational purposes only and do not alter the French version of these Terms of Use in any way. In case of conflict between the translation of these Terms of Use and their French version, the latter shall prevail in all cases.
CONDITIONS OF ACCESS AND REGISTRATIONITIONS
The User acknowledges having the skills and equipment (computers, software, tablets, smartphones, telecommunication means, etc.) necessary to access the Services and agrees to bear the cost related to these equipments (telecommunication costs, internet subscription fees, etc.). In order to use the service, the User who wishes to become a Member and use the Service must register on
www.baguetteacademy.com website, by filling in the registration form on www.baguetteacademy.com website, and specifically fill out all the mandatory fields regarding their Personal Data (as this term is defined herein) and approves the Terms of Use as provided during the registration process. The User who wishes to become a Member affirms and guarantees:
- That all the information communicated at the time of registration is complete, authentic and exact,
- That the said information will remain complete, authentic and accurate,
- That his or her use of the Services is not and will not be contrary to public order, good morals, the laws and regulations in force that are applicable to him or her.
Each Member has an identifier and a password. These identifier and password are strictly personal and confidential and must not be communicated or shared with third parties. Each Member also has, in the case of a validated order of one or more training module(s), access elements to said training module(s). These access elements are personal, confidential, and intended for personal use by the concerned Member only. Access to the training module(s) cannot in any case be transferred, transmitted, or shared with a third party, whether free of charge or for a fee. In case of a breach of this obligation by the Member, BAGUETTE ACADEMY reserves the right to suspend access to the concerned training module(s) and to www.baguetteacademy.com, without compensation, notice, or prior information and subject to any subsequent legal action.
Each Member is solely responsible for maintaining the confidentiality of his or her login, password and, where applicable, access elements to the training module(s), as well as for any actions, fraudulent or otherwise, that may be carried out using his or her login and password or by using his or her access elements to the training module(s). In this regard, BAGUETTE ACADEMY strongly recommends that Members avoid using www.baguetteacademy.com from a public workstation or via a captive community portal and, where applicable, always ensure that they have closed their session before leaving a workstation.
Each Member undertakes not to use, at any time, the account, login, password or access details of another Member. Any Member who suspects unauthorised access to his or her login, password and/or access data and/or unauthorised use of his or her account must inform BAGUETTE ACADEMY as soon as possible, which will take appropriate measures.
Each Member shall indemnify BAGUETTE ACADEMY against any claims arising from actions or statements made on www.baguetteacademy.com through his/her personal Member account.
The creation of an account is subject to validation of these Terms of Use.
DESCRIPTION OF THE SERVICES OFFERED
BAGUETTE ACADEMY develops and provides its Members with digital (e-learning), face-to-face, or blended (face-to-face and digital) training courses, as well as occasional study and consulting missions. The training and consulting services offered by BAGUETTE ACADEMY are limited to the field of professional bakery and subjects directly or indirectly related to professional bakery. The services enable members to train in the techniques and methods of professional bakery as well as in subjects directly or indirectly related to professional bakery, such as, for example and without limitation, ingredients, equipment, recipes, sales techniques, merchandising, hygiene, and safety of people and equipment. The services also allow for the exchange of public or private messages between members. The online courses primarily consist of texts, photos, animations, videos, and quizzes. Users have the option to retake the training multiple times, including the final quiz, within a limited time frame. BAGUETTE ACADEMY also offers face-to-face training courses according to a program and with objectives defined with the user prior to the training. It is also possible to create customized training paths combining online training and face-to-face training adapted to the user’s needs.
DIGITAL TRAINING (E-LEARNING)
Digital trainings are reserved for Members registered on www.baguetteacademy.com and who have made the payment corresponding to the selected training module(s).
To access the digital trainings, the Member must comply with the access and registration conditions detailed in the section CONDITIONS OF ACCESS AND REGISTRATION above. The Member must then determine which training(s) they wish to follow from the catalog offered by BAGUETTE ACADEMY. To do this, the Member must select on www.baguetteacademy.com the training(s) they wish to follow, fill out the registration form specific to the selected training(s), and make the payment corresponding to the selected training(s).
Once the payment for the selected module(s) is made, the Member receives an email at the address provided during registration, containing the elements that allow them to activate access to the training module(s). After entering their access details, the Member has unrestricted access to the selected module(s) 24 hours a day, 7 days a week, for the duration specified in the training description. Each training module has a descriptive sheet accessible on the website www.baguetteacademy.com.
It is specified that each training module may be subject to modifications by BAGUETTE ACADEMY without such modification entitling to any form of compensation. Upon completion of the training and provided that the concerned Member has successfully passed the final quiz, BAGUETTE ACADEMY will make available for download a certificate attesting to the proper completion of the digital training by the said Member.
FACE-TO-FACE TRAINING
Face-to-face training courses are offered as a priority to Members registered on www.baguetteacademy.com who have selected a face-to-face course from the training catalogue available on www.baguetteacademy.com.
All face-to-face training will be subject to a prior commercial and financial proposal by BAGUETTE ACADEMY, which will be sent to the User who has made the request. This commercial proposal shall define the main terms and conditions of the face-to-face training offered to the User and shall be accompanied by the General Terms and Conditions of Sale applicable specifically to face-to-face training.
www.baguetteacademy.com is only intended to introduce Users to the face-to-face training courses offered by BAGUETTE ACADEMY, and participation in these courses must be handled directly with BAGUETTE ACADEMY’s sales department.
CONSULTANCY SERVICES
All consulting services shall be subject to a prior commercial and financial proposal by BAGUETTE ACADEMY, which shall be sent to the User who has made the request. This commercial proposal shall define the main terms and conditions of the face-to-face training offered to the User and shall be accompanied by the General Terms and Conditions of Sale applicable specifically to consulting services.
www.baguetteacademy.com is only intended to present to Users the consulting services offered by BAGUETTE ACADEMY; orders for such services must be processed directly with BAGUETTE ACADEMY’s sales department.
RATES
The prices of the training modules on www.baguetteacademy.com are prices including VAT in euros. They shall be increased by any tax other than VAT and by any other applicable taxes, duties and fees that are payable by the User. BAGUETTE ACADEMY reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalogue on the day the order is placed will be the only one applicable to the User.
ORDERING
The User who wishes to purchase one or more training modules must, after registering as a Member on www.baguetteacademy.com, fill in the online order form giving the references of the training module(s) chosen. He/she must then validate his/her order after having checked it, make the payment in accordance with the conditions provided and then confirm his/her order and payment. All the data provided and the recorded confirmation will be considered as proof of the transaction. The confirmation will be worth signature and acceptance of the operations carried out. BAGUETTE ACADEMY will send the User confirmation of the order recorded by e-mail.
RETRACTATION
In accordance with the provisions of Article L.121-21-8 13° of the French Consumer Code, the Member is hereby informed that the provision of digital content not provided on a physical medium and whose execution has begun after the Member’s express prior agreement, does not, due to its nature, give rise to the right of withdrawal provided for in Article L.121-21 of this Code. Consequently, the Member subscribing to a digital training offer proposed by BAGUETTE ACADEMY expressly confirms that he/she agrees not to benefit from the right of withdrawal related to this service.
PAYMENT TERMS
Payment for the Services is required at the time of ordering. The payment of the price is possible by credit card (VISA, MASTERCARD) directly on www baguetteacademy.com. The card is debited as soon as the order is placed. Payment can also be made by PAYPAL transfer. The amount of the purchases is immediately debited from the User’s PAYPAL account. The order is considered validated after confirmation of the agreement of the banking payment centres. The User guarantees to be the holder of the means of payment used to pay for the Services ordered or to have the necessary authorisations to use them. BAGUETTE ACADEMY makes its best efforts to optimise the security of financial transactions from www.baguetteacademy.com. In this regard, the User releases BAGUETTE ACADEMY from any liability in the event of a failure in the transfer of banking data. In all cases, the User’s account will be debited before access to the Services is granted.
FUNCTIONING OF THE SERVICES
ALL SERVICES ARE PROVIDED AS IS AND TO THE EXTENT TECHNICALLY POSSIBLE.AS A RESULT, EACH USER ACKNOWLEDGES THAT :
- BAGUETTE ACADEMY DOES NOT GUARANTEE THAT BAGUETTEACADEMY.COM AND THE SERVICES WILL FUNCTION WITHOUT INTERRUPTION OR OPERATING ERROR, NOR DOES IT GUARANTEE THE SECURITY AND QUALITY OF WWW.BAGUETTEACADEMY.COM,
- BAGUETTE ACADEMY DOES NOT GUARANTEE THAT THE DIGITAL TRAINING MODULES WILL BE ACCESSIBLE ON ALL TERMINALS, SUCH AS LAPTOPS, GAME CONSOLES, SMARTPHONES, TABLETS OR OTHER MEDIA.
- BAGUETTE ACADEMY DOES NOT EXERCISE ANY CONTROL OR SUPERVISION OVER THE CONTENT EXCHANGED AND PUT ONLINE BY USERS AND CANNOT BE HELD RESPONSIBLE IN THIS RESPECT,
- BAGUETTE ACADEMY DOES NOT EXERCISE ANY CONTROL OVER THE PRIVATE AND/OR EXCHANGE AND DISCUSSION AREAS WITHIN BAGUETTEACADEMY.COM AND EACH USER OF THESE AREAS IS FREE TO ADD, MODIFY OR DELETE ANY INFORMATION APPEARING THERE; AS A RESULT, BAGUETTE ACADEMY CANNOT BE HELD RESPONSIBLE FOR THE PUBLICATION OR DELETION OF DATA BY A USER OR FOR ANY OTHER ACT OF A USER WITHIN SUCH AN AREA,
- BAGUETTE ACADEMY SHALL IN NO EVENT BE LIABLE FOR ANY LOSS OR DAMAGE TO DATA OR FOR ANY IMPROPER OR UNAUTHORISED USE OF CONTENT STORED AND DISCLOSED THROUGH BAGUETTEACADEMY.COM,
- BAGUETTE ACADEMY MAY TERMINATE OR CHANGE THE FEATURES OF ITS SERVICES AT ANY TIME WITHOUT NOTICE.
- BAGUETTE ACADEMY CANNOT BE HELD RESPONSIBLE FOR THE CONNECTIONS AND RELATIONSHIPS THAT USERS MAY HAVE WITH EACH OTHER, AND WHICH MAY HAVE BEEN ESTABLISHED VIA WWW.MYBAGUETTE ACADEMY.COM.
- BAGUETTE ACADEMY CANNOT BE HELD RESPONSIBLE FOR THE AUTHENTICITY OF THE INFORMATION PROVIDED BY USERS, NOR DOES IT MONITOR USERS IN ANY WAY.
- BAGUETTE ACADEMY CANNOT BE HELD RESPONSIBLE FOR ANY DAMAGES WHATSOEVER, WHETHER DIRECT OR INDIRECT, TANGIBLE OR INTANGIBLE, ARISING FROM THE RELATIONSHIP BETWEEN USERS, PARTICULARLY IN THE EVENT OF CONTACT BETWEEN USERS VIA BAGUETTEACADEMY.COM.
- BAGUETTE ACADEMY RESERVES THE RIGHT TO CARRY OUT ANY MAINTENANCE OPERATION ON ITS SERVER BUT UNDERTAKES TO PROVIDE ITS BEST EFFORTS TO LIMIT THE INTERRUPTION OF SERVICES TO A MINIMUM.
MORE GENERALLY, BAGUETTE ACADEMY CANNOT GUARANTEE AND DOES NOT PROMISE ANY PARTICULAR RESULT FROM THE USE OF WWW.BAGUETTEACADEMY.COM, NOR CAN IT GUARANTEE THE USER AGAINST THE RISKS INHERENT IN THE USE OF THE INTERNET AND THE NETWORKS, IN PARTICULAR AS REGARDS THE CONFIDENTIALITY OF THE DATA EXCHANGED.
THE USER DECLARES THAT HE/SHE FULLY ACCEPTS THE CHARACTERISTICS AND LIMITATIONS OF THE SERVICES. ANY CLAIM RELATING TO A NON-CONFORMITY (LACK OF CORRESPONDENCE BETWEEN THE MODULE(S) DELIVERED AND THOSE ORDERED) OR AN ANOMALY (ANY BREAKDOWN, INCIDENT, BLOCKAGE, DEGRADATION OF THE PERFORMANCES NOT ALLOWING A NORMAL USE OF THE ORDERED SERVICES) OF THE DELIVERED TRAINING MODULE(S) MUST BE ADDRESSED TO BAGUETTE ACADEMY AT THE ELECTRONIC ADDRESS [email protected] WITHIN 8 DAYS FOLLOWING THE COMMUNICATION OF THE ACCESS ELEMENTS TO THE TRAINING MODULE(S). IT SHALL BE THE RESPONSIBILITY OF THE USER TO PROVIDE ANY JUSTIFICATION AS TO THE REALITY OF THE ANOMALIES OR NON-CONFORMITIES NOTED. THE USER MAY NOT UNDER ANY CIRCUMSTANCES TAKE ADVANTAGE OF A MATERIAL INCOMPATIBILITY SUBSEQUENT TO ITS FIRST USE. BAGUETTE ACADEMY UNDERTAKES TO MAKE ITS BEST EFFORTS TO REMEDY ANY NON-CONFORMITY, ANOMALY OR TECHNICAL MALFUNCTION AS QUICKLY AS POSSIBLE WITHOUT HOWEVER GUARANTEEING THE UNINTERRUPTED AND ERROR-FREE OPERATION OF THE TRAINING MODULE(S).
OBLIGATIONS OF USERS
The User shall refrain, in the course of using the Services, from engaging in acts of any kind whatsoever that would be contrary to the legislative and regulatory provisions of the French Republic and/or would infringe upon public order or the rights of a third party. In particular, without this list being exhaustive and at BAGUETTE ACADEMY’s sole discretion, the User agrees not to :
- using the Services for any purpose other than normal use,
- publishing, transmitting, disseminating, editing or making available on or through www.baguetteacademy.com any content that could constitute, without this list being restrictive, defamation, insults, threats, blackmail, harassment, incitement to violence, racial hatred and more generally to the realization of crimes and misdemeanors; propagation of false news or financial information covered by secrecy, as well as any content intended to represent or offer for sale objects and/or works, software, content prohibited by law or infringing on the rights of third parties infringement of privacy, protection of personal data or secrecy of correspondence; apology for crimes against humanity or denial of genocide; disclosure of information covered by secrecy or by the right to privacy; or acts endangering minors, in particular by the production, transmission, dissemination or accessibility of messages of a violent or pornographic nature, of a nature to undermine human dignity or of a nature to enable the manufacture of explosives,
- attempting to mislead other Users, in particular by usurping the identity or damaging the image or reputation of others,
- falsify data, messages or documents, message headers or identification or connection data or manipulate in any other way an identifier in order to conceal the origin of the transmission of content via www.baguetteacademy.com,
- infringe the intellectual property rights (including but not limited to music, video, animation, games, software, databases, images, sounds and text) or other proprietary rights of others,
- send or cause to be sent any unsolicited e-mail or instant messages, such as advertisements, promotional materials, chain letters or any other form of unsolicited direct marketing, to any person or persons who have not requested them or who have not respected their legal rights
- knowingly upload, post, transmit, broadcast, transmit or otherwise make available any content that contains or consists of computer viruses or any other computer code or programs designed to interrupt, destroy, hijack or limit the functionality or performance of any computer software, hardware, service or electronic communications equipment, without limitation
- disrupt, slow down, block or interfere with the normal flow of data exchanged under any of the Services, modify or alter or commit any other action that has an equivalent disruptive effect on the functionality of www.baguetteacademy.com,
- to post, indicate, or disseminate in any form whatsoever information or content that has the effect of diminishing, disorganising, or preventing the normal use of the Services, or interrupting and/or slowing down the normal flow of communications between Users via the Services, such as software, viruses, logic bombs, mass mailings, etc..
- to post, indicate or disseminate in any form whatsoever information or content including links to third party sites that are illegal and/or contrary to good morals,
- act unfairly towards BAGUETTE ACADEMY and consequently disrespect and damage in any way the image and reputation of BAGUETTE ACADEMY, www.baguetteacademy.com and the Services.
PROTECTION OF COPYRIGHT AND OTHER INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
The whole of www.baguetteacademy.com is subject to French and international legislation on copyright and intellectual property All reproduction rights are reserved, including for downloadable documents and iconographic, photographic and audiovisual representations. The violation of copyright is an infringement of copyright, punishable, under the terms of Article L.335-2 of the Intellectual Property Code, by two years’ imprisonment and a fine of 150,000 Euros. More specifically, BAGUETTE ACADEMY is the sole owner of the intellectual property rights to all of the training modules it offers to its Users. To this end, all content and teaching aids, regardless of their form, remain its exclusive property and may not be used, transformed, reproduced or exploited in any way that is not expressly authorised. In particular, the User shall refrain from using the content of the training courses to train other people and shall be liable in this respect in the event of unauthorised transfer or communication of the content. Any reproduction, representation, modification, publication, transmission, denaturation, total or partial of the contents of the training courses are strictly forbidden, whatever the process and the support used. The User only has a personal, non-transferable and non-exclusive right of use for a limited time. The submission to BAGUETTE ACADEMY of ideas, suggestions, documents and/or proposals concerning the Services via the various BAGUETTE ACADEMY email addresses or by any other mechanism (collectively referred to as the “Contribution”), entails express recognition that: (i) the Contribution does not contain confidential or proprietary information (ii) BAGUETTE ACADEMY shall not be subject to any obligation of confidentiality, express or implied, with respect to the Contribution; (iii) BAGUETTE ACADEMY shall have the right to use or disclose (or choose not to use or disclose) the Contribution for any purpose and in any manner whatsoever; (iv) BAGUETTE ACADEMY may already have under consideration or development a service or product similar in whole or in part to the Contribution; and (v) the Contribution shall automatically become the property of BAGUETTE ACADEMY without any consideration; and (vi) the person who made the Contribution shall not be entitled to any remuneration, compensation, indemnification or reimbursement of any kind from BAGUETTE ACADEMY for any reason whatsoever. The User undertakes to respect the intellectual property rights of third parties. In this regard, the User shall not upload, download, integrate, publish, send, transmit or make available any content that infringes any copyright, patent, trademark, trade secret or any other intellectual and/or industrial property right. Any hypertext link to www.baguetteacademy.com using the framing, deep-linking, in-line linking or any other deep-linking technique is in any case strictly prohibited.
In any case, any link, even tacitly authorised, must be removed on simple request from BAGUETTE ACADEMY.
PERSONAL DATA
In compliance with [the General Data Protection Regulation (RGPD), n°2016/679 of 27 April 2016, as well as all the rules of national law taken in application of this one, in particular, the law n° 78-17 of 6 January 1978 relating to data processing, files, freedoms known as law “Data processing and Freedoms”, on a subsidiary basis], the automated treatment of the personal data carried out from www. baguetteacademy.com has been declared to the Commission Nationale de l’Informatique et des Libertés (CNIL).
In accordance with [the General Data Protection Regulation (RGPD)] and Law No. 78-17 of 6 January 1978, the user may at any time access, modify or delete any personal information held by BAGUETTE ACADEMY. Thus, in accordance with the provisions of [Chapter 3 on the rights of the persons concerned of the RGPD] Chapter V of the French Data Protection Act, the User may request that his/her information be rectified, completed, clarified, updated or deleted if it is inaccurate, incomplete, equivocal, outdated, or if its collection, use, communication or storage is prohibited.Upon closure of a member’s account or after a period of inactivity of 3 months, their personal data will be permanently deleted from our database.
For the purposes of these terms and conditions, a User’s personal data includes, but is not limited to, his or her first and last name, date of birth, language, profession, sector of activity, gender, address, country of residence, user name, password, e-mail address, images, photographs, videos or any other elements communicated, contacts with other Users, comments (hereinafter referred to as ” Personal Data”).
Users are advised never to communicate Personal or confidential Data via www.baguetteacademy.com. If a User decides to disclose such information to other Users, they will be solely responsible, and BAGUETTE ACADEMY will not be held accountable in this regard. Each user can exercise their rights by writing to [email protected].
COOKIES
BAGUETTE ACADEMY may collect and store identification data relating to Users in order to avoid having to manually enter their identifiers each time they connect, as well as Users’ browsing data for the purpose of providing and improving the Services and for statistical purposes. This information is stored by BAGUETTE ACADEMY, in particular by means of cookies or similar technologies (hereinafter, “Cookies”). BAGUETTE ACADEMY is not responsible for any changes or updates to such sites. BAGUETTE ACADEMY is not responsible for the transmission of information from such sites, nor for the malfunctioning of such sites. NON-COMPLIANCE WITH THE GENERAL CONDITIONS
BAGUETTE ACADEMY reserves the right, in its sole discretion, to reject, refuse to post or remove any content posted on www.baguetteacademy.com website, and to restrict, suspend or terminate a User’s access to all or any part of the Services at any time, including, without limitation, in the event that the User fails to comply with any of its obligations as set forth herein. The User shall indemnify and hold harmless BAGUETTE ACADEMY from any loss, liability, claim or demand (including, but not limited to, reasonable attorneys’ fees), suffered by or made by any third party due to the User’s use of the Services in violation of this Agreement. In the event of illegal or unauthorised use of the Services, BAGUETTE ACADEMY reserves the right to take any appropriate action, including reporting the violation to the judicial and/or law enforcement authorities.
RESPONSABILITY
BAGUETTE ACADEMY may not be held liable for any technical failure of www.baguetteacademy.com, any misuse of the Services or for any cause beyond the control of BAGUETTE ACADEMY. In all cases, BAGUETTE ACADEMY’s liability is expressly limited to compensation for direct damages that the User can prove and is capped at the amount paid by the User for access to the Services. Under no circumstances shall BAGUETTE ACADEMY be held liable for indirect damages such as loss of data, files, operating losses, commercial losses, loss of earnings, damage to image, etc. Any circumstances beyond the control of BAGUETTE ACADEMY occurring after the User’s order and preventing its execution under normal conditions shall be considered as grounds for exoneration. Circumstances beyond the control of QINTEQ within the meaning of this clause shall be deemed to be circumstances that are not the result of a fault on its part and, in particular, all cases of force majeure.
TERMINATION
In the event of a breach of any of the essential obligations arising from the Terms of Use of www.baguetteacademy.com website,, BAGUETTE ACADEMY shall be entitled, without prior notice and with immediate effect, to deactivate any account, which shall automatically result in the definitive inaccessibility of all content and the termination, without compensation, of any subscriptions to the Services attached to said account. Finally, in the event of non-use of the account for three hundred and sixty-five (365) consecutive days, the account may be deleted by BAGUETTE ACADEMY. INVALIDITY OF A CLAUSE
If one or more provisions of the Terms of Use are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other provisions shall retain all their force and scope and the necessary amendments shall be made without delay.
RENONCIATION
The failure of either party to enforce any provision of the Terms of Use, whether permanently or temporarily, shall not be deemed a waiver of that party’s rights under such provision.
APPLICABLE LAW – COMPETENT JURISDICTION
THE TERMS OF USE ARE GOVERNED BY FRENCH LAWS AND REGULATIONS AND BY THE LANGUAGE OF THE FRENCH REPUBLIC. THE USER AGREES THAT ANY DISPUTE SHALL BE SETTLED BEFORE THE COURTS OF THE FRENCH REPUBLIC. In the event of disputes or claims arising from the User, BAGUETTE ACADEMY or a third party, relating to the use of www.baguetteacademy.com, only the version of the Terms of Use available on www.baguetteacademy.com shall be binding between the parties, regardless of the date of the disputed facts.
In the event of difficulty in the interpretation or execution of the Terms of Use, the parties shall endeavour to resolve their dispute amicably. In case of persistent disagreement, of more than one (1) month, as from the first notification concerning the dispute, any dispute likely to arise between the parties concerning the formation, the execution, the interpretation or the termination-resolution of the present Terms of Use will be under the exclusive competence of the Courts of the jurisdiction of the Court of Appeal of LYON, including in case of summary proceedings, petition or multiple defendants.I HAVE READ THE TERMS OF USE AND I ACCEPT ALL THE CLAUSES MENTIONED ABOVE.
